New City Motorcycles Ltd – Terms and Conditions of Sale
These Terms and Conditions (“Terms”) govern the sale of used motorcycles by New City Motorcycles (“the Company,” “we,” “us,” or “our”) to the customer (“the Customer,” “you,” or “your”) and the purchase of used motorcycles from customers (“the Seller”). By placing an order, paying a deposit, or selling a motorcycle to us, you agree to be bound by these Terms.
- Definitions
- “Vehicle” means the used motorcycle purchased by the Customer.
- “Deposit” means the sum paid by the Customer to secure the Vehicle.
- “Invoice” means the document detailing the sale of the Vehicle, including the price and payment terms.
- “Distance Sale” means a sale where there is no face-to-face contact between the Company and the Customer.
- Deposit and Payment
- Deposit Secures Vehicle: A deposit secures the vehicle for seven (7) calendar days from the date of payment, unless a different timeframe is agreed upon at the point of sale.
- Balance Payment: The remaining balance on the invoice is due within seven (7) calendar days of the deposit payment, unless otherwise agreed at the point of sale. Failure to pay within this timeframe may result in the forfeiture of the deposit and the vehicle being re-advertised.
- Deposit Refundability:
- Deposits are non-refundable for vehicles inspected in person prior to deposit payment.
- For distance sales, deposits are refundable within the first seven (7) calendar days, after which full payment is required.
- Payment Before Possession: Full payment of the invoice is required before the customer takes possession of the vehicle.
- Payment Currency: All payments must be made in pounds sterling (GBP) unless otherwise agreed in writing.
- Accepted Payment Methods: We accept bank transfers, debit or credit card payments (excluding American Express), and finance options (subject to availability). Cash payments may be accepted with prior confirmation and may be subject to limitations.
- Vehicle Condition and Warranty
- All Vehicles are sold as used and are subject to wear and tear commensurate with their age and mileage.
- We make every effort to provide accurate descriptions of Vehicles, but minor cosmetic imperfections may exist. Customers are encouraged to inspect Vehicles thoroughly before purchase.
- While we strive to provide accurate mileage readings, exact mileages cannot be guaranteed. We will always inform customers if there are any discrepancies or uncertainties regarding a vehicle’s mileage.
- All our bikes are sold with a minimum of 6-months MOT. If the MOT is less than this at the point of sale, we will arrange for a new MOT to be completed prior to delivery/collection of the vehicle.
- Any warranties provided will be clearly stated in writing and provided with paperwork upon collection/delivery.
- Title and Risk
- Title to the Vehicle shall pass to the Customer upon receipt of full payment of the Invoice.
- Risk of loss or damage to the Vehicle shall pass to the Customer upon delivery or collection.
- Customer Obligations
- The Customer is responsible for providing accurate and complete information.
- The Customer must hold a valid motorcycle license and appropriate insurance to operate the Vehicle.
- Limitation of Liability
- The Company shall not be liable for any indirect, consequential, or incidental damages arising from the sale of the Vehicle.
- Our liability is limited to the purchase price of the Vehicle.
- Nothing in these Terms and Conditions shall affect the Customer’s statutory rights under the Consumer Rights Act 2015.
- Personal Data
- We will process your personal data in accordance with our Privacy Policy, which is available on our website at HTTPS://WWW.NEWCITYMOTORCYCLES.CO.UK/PRIVACY-AND-COOKIE-POLICY/. This policy explains how we collect, use, store, and protect your personal information.
- Customer Feedback and Marketing
- Feedback Requests: We may contact you to request your feedback on your purchase experience with us.
- Review Requests: We may send you requests to leave a review of our services or the motorcycle you purchased on relevant platforms.
- Social Media Content: With your express consent, we may request to use photos of you with your purchased motorcycle for our social media channels and other marketing materials. We will always seek your permission before using any such images.
- Storage Charges
- If the Customer fails to collect the Vehicle within ninety (90) calendar days of full payment, a storage charge of £12.50+vat per day will be applied.
- The Company reserves the right to dispose of the vehicle if storage charges exceed the value of the vehicle.
- Storage charges must be paid in full before the vehicle can be collected.
- Seller Obligations (Selling a Motorcycle to New City Motorcycles Ltd)
- When selling a motorcycle to the Company, the Seller must provide valid photographic identification (e.g. driver’s license, passport).
- The Seller must provide the vehicle’s logbook (V5C) in their name, demonstrating legal ownership.
- The Seller warrants that they have the legal right to sell the motorcycle and that it is free from any outstanding finance agreements or encumbrances.
- The Seller warrants that the motorcycle is not recorded as stolen or subject to any insurance write-off categories, and is HPI clear.
- The Seller is responsible for ensuring the accuracy of all information provided regarding the motorcycle’s condition and history.
- The Company reserves the right to conduct its own checks, including HPI checks, to verify the motorcycle’s history and ownership. Any discrepancies found may result in the termination of the purchase agreement.
- If found that the bike has outstanding finance, or is stolen, the company will withhold payment, and provide all information to the relevant authorities.
- Customer Responsibility (Purchasing a Motorcycle from New City Motorcycles Ltd)
- The Customer is responsible for arranging and securing valid road tax (Vehicle Excise Duty) for the Vehicle prior to riding it on public roads.
- The Customer must obtain valid and adequate motorcycle insurance coverage before taking possession of and riding the Vehicle.
- The Company accepts no responsibility or liability for the Customer’s failure to comply with licensing, road tax, or insurance requirements.
- Delivery
- Delivery of the Vehicle is subject to an additional charge, as specified on the Invoice.
- If the vehicle has been financed through the company, and delivery is opted for, the vehicle can only be delivered to the customers home or work address as listed on their finance application.
- Regardless of payment method, the Customer (or a pre-authorized individual) must be present at the delivery address to receive, sign for, and inspect the Vehicle.
- The Customer (or pre-authorized individual) must provide valid photographic identification (e.g., driver’s license, passport) upon delivery.
- If the vehicle has not been financed, then the vehicle can be delivered to any address the customer requests, providing the customer is there to receive the bike, sign and show photo ID.
- Promotional Flyers
- £100 Off Motorcycle Sale: This flyer entitles the bearer to £100 off the purchase price of a motorcycle.
- Valid at Point of Sale: Flyer must be presented to the sales representative at the time of purchase.
- One Per Sale: Only one flyer can be used per motorcycle sale.
- Vehicle Sales Only: This offer applies to motorcycle sales only and excludes other products or services.
- Excludes Other Offers: This discount cannot be combined with any other discounts or promotional offers.
- Offer Subject to Change: The business reserves the right to terminate or modify this offer at any time without notice.
- Right to Decline: The business retains the right to refuse the discount at its discretion.
- Debt Collection
- In the event of non-payment of any Invoice within the specified timeframe, the outstanding balance will be referred to a debt collection agency. The Customer shall be liable for all costs associated with debt collection.
- Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of England and Wales.
- Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- Amendments
- We reserve the right to amend these Terms at any time. Any changes will be posted on our website and will apply to all subsequent sales.
